Are you eligible for support?

In some situations, local authorities can provide accommodation and financial support to families who have children. This is possible even if the parents have no access to welfare benefits, or ‘no recourse to public funds’.

Support is provided under section 17 of the Children Act 1989 (section 17). Support under section 17 is normally organised by social services departments within local authorities. However, some local authorities have set up specific ‘teams’ to deal with administering support.

You can only access support under section 17 in certain circumstances. These circumstances are described in the following pages.

1. Is your child a 'child in need'?

2. Would failing to provide support breach Human Rights?

3. Is there a legal reason you cannot return to your country of origin?

4. Is there a practical reason you cannot return to your country of origin?
